Responsibilities
  • Oversee and manage public defender services within assigned regions of the Conflict Defender Office.
  • Determine whether conflicts exist in referred cases and assign cases appropriately.
  • Implement standards and procedures established by the Conflict Defender Division Administrator and the Office of the State Public Defender.
  • Maintain a client caseload and handle all phases of multi-forum litigation for indigent clients.
  • Research and prepare legal defenses based on facts, investigations, and legal research.
  • Keep clients informed and prepared for all stages of representation, including hearings, proceedings, and trials.
  • Hire and manage public defenders and support staff.
  • Provide consultation, case assessment, legal advice, recommendations, settlement negotiations, and legal decision-making.
  • Represent clients in court, trials, and official proceedings.
  • Review and prepare legal documents, opinions, forms, contracts, permits, and other legal agreements.
  • Prepare findings of fact, conclusions of law, and judgments after administrative and court proceedings.
  • Interpret and apply state and federal laws and administrative rules.
  • Interview parties, witnesses, and experts involved in legal proceedings.
  • Research and respond to questions or complaints and explain policies and procedures.
  • Provide direction and guidance on cases involving substantial legal precedent and advise on new laws without established precedent.
  • Serve as a legal advisor across multiple fields of law.
  • Ensure fiscally sound resource use involving employees and contract services.
  • Ensure accurate and timely collection and reporting of operational data and information.
  • Review potential conflicts of interest and make final conflict determinations.
  • Oversee contract services and ensure compliance with agency practice standards.
  • Manage complaints regarding public defender performance and resolve conflicts of interest ethically.
  • Ensure proper caseload management in accordance with agency policies and procedures.
  • Manage sensitive public, political, and division-specific issues.
  • Supervise public defenders and support staff.
  • Maintain an active performance evaluation process for office employees and contractors.
  • Oversee training, mentoring, and progressive discipline in a union environment.
  • Ensure capital-case counsel assignments comply with Montana Supreme Court standards.
  • Develop relationships with prosecutors, judges, law enforcement, corrections, elected officials, nonprofit organizations, and other stakeholders.
  • Cultivate relationships with contract attorneys.
  • Represent the agency at local, state, and national meetings.
  • Respond to inquiries from the media, professional organizations, and the public and defend agency decisions when necessary.
  • Testify in legislative hearings regarding division operations, legislation, and budget matters.
Desired Qualifications
  • At least five years of progressively responsible management experience, including supervision of professional and support staff, budgeting, organizational, and operational functions.
  • Practical legal experience, preferably in criminal and civil litigation involving public defense actions.
